Delivery times and shipping

The ordered products will be delivered through express delivery. The delivery times, for the continent, on principle are 2 work days except for difficult to reach areas (such as islands) the delivery time of which may extend up to 3 work days. The shipping cost will be calculated automatically by the server based on the purchased products and the place to which we must ship. For cash on delivery there is an additional cost of € 6.00.

Conditions of online sales

Art. 1 – Object: the following general conditions apply to the purchase of products through portal "www.spinnakerpesca.it"; every product on sale is on the website. All operations concerning purchase are structured in compliance with the provisions of Leg. Decree No. 206 of 6 September 2005, and Leg. Decree No. 196 of 30 June 2003.

Art. 2 – Acceptance of the General Conditions of Sale: the Customer, by confirming his order, accepts unconditionally and undertakes to comply with the general conditions and payment arrangements, acknowledging that the Seller Company does not consider itself bound to different conditions unless specified beforehand.

Art. 3 - Availability of the products: The products on this website may not be immediately available once the order is placed. Spinnaker undertakes to inform the Customer by telephone or by e-mail of the present unavailability. If the quantity requested by the Customer is greater than what is present in the shop, Spinnaker will accept the purchase only for the part available by notifying the Customer on the possible future availability of the products.

Art. 4 – Customer's obligations: the conditions of sale must be examined on-line by the Customer before he confirms the order. The forwarding of the order will be considered as acceptance of every written condition. The Customer undertakes and is obliged, after completing the purchase procedure, to print and keep the conditions of sale previously viewed and accepted in order to meet fully art. 53 of Leg. Decree No.206/2005

Art. 5 – Method of purchase and drawing up of the contract: purchase of the products is made by the Customer at a price including VAT, to be confirmed at the time of the order confirmation, increased by the shipping costs as specified subsequently and anyhow viewed at the time of purchase. Before confirming the purchase, the Customer will be shown the cost of each product, the total cost and the shipping costs. Finally, the Customer shall undertake to check the correctness of the shipping data and of the selected articles.

Art. 6 – Payments: payment of the selected products and the related shipping costs must be effected through one of the following methods:

Credit cards (Visa, MasterCard, American Expess, Postepay)
PayPal
COD (Cash On Delivery)
Advance Bank wire transfer
Collection in the shop

Art. 7 – Delivery of the Products: delivery of the products will be carried out during work days; the delivery times generally range from 24 to 72 hours except for physical or structural hindrances such as incorrect address and/or adverse weather conditions. The shipping cost shall be calculated automatically by the server. Once the products are delivered, the Customer must check the integrity, the presence of defects and possible mistakes by the shop in shipping the goods. Only after checking of the products is completed, the Customer shall be asked to sign the Delivery Note. After signature the Customer shall be unable to dispute any of the goods. In the event in which, during checking of the products before signing the Delivery Note, there are inconsistencies between the ordered goods and the delivered goods or visible damage, the Customer shall be asked not to accept the goods and raise the dispute directly against the carrier. In this last case the Customer shall not be charged any shipping costs.

Art. 8 – Guarantees: the products are subject to the guarantees foreseen by Leg. Decree 206/05. This guarantee shall apply to products that have defects of compliance and/or failures not evident at the time of purchase, provided that the product is used properly and with the due diligence and fairness.

Art. 9 – Right of cancellation: in pursuit and within the limits of Leg. Decree 206/05, the Customer is entitled to exercise the right of cancellation within 10 work days from receipt of the requested goods. To exercise the right of cancellation the Customer must send, within the time limit specified previously, a registered letter with return receipt acknowledged to the following address: Spinnaker Pesca, Daniele Buti, owner, No. 9, Via A. Diaz, Cecina (LI) - 57023, Tel.: +39 0586 680042. The Seller Company shall proceed to refund the relative cost of the shipped goods within 14 work days from receipt of the goods in the shop. The refund by the shop shall be effected through bank credit or the credit card used for payment. The costs of the returned goods to the Seller Company are at the Customer’s charge except if the goods are returned directly to the carrier who carries out the delivery. The shop shall reject any returned product if not properly packed, if the return expenses are not paid in full by the Customer, if the times set out by law art. 64 Leg. Decree 206/2005 are not met for the communication of the right of cancellation or if the products have no defects reported upon delivery.

Art. 10 – Privacy: the Customer states of having read the information provided in pursuit to art. 13 of Leg. Decree 196/2003, when filling out the online forms necessary to complete his purchases. Pursuant to Leg. Decree No. 196/2003, the Customer furthermore states to acknowledge that, if during recording it was expressly permitted by him, the provided data can be used only for promotional, commercial, sales and statistical purposes only.

Art. 11 – Jurisdiction and competent Court: this contract shall be governed by Italian Law. For any dispute concerning the validity, interpretation or execution of this contract the territorial jurisdiction is of the Court of the place of residence or domicile of the consumer, if located within the territory of the Country.
